Terms of Service

1. Preamble and definitions

These Terms of Service (hereinafter "Terms") govern access to and use of the candidat.app service (hereinafter "Service"), operated by Victor Charton, a sole proprietorship under Swiss law, based in Rolle (Vaud), Switzerland (hereinafter "Publisher").

For the purposes of these Terms:

  • "User" means any natural person, adult or minor over 16 years old, accessing the Service.
  • "Account" means the personal space created by the User on the Service.
  • "Application" means the bundle (tailored CV + cover letter) generated for a job posting.
  • "Subscription" means the paid plan subscribed by the User (Basic or Pro).

Registration to the Service constitutes full and unconditional acceptance of these Terms.

2. Purpose of the service

candidat.app is a Swiss SaaS job-application assistant aimed at job seekers in French-speaking Switzerland. The Service uses generative artificial intelligence to:

  • Extract the content of a job posting provided by the User (URL or text)
  • Tailor the User's CV to the targeted posting
  • Generate a personalised cover letter
  • Store generated Applications and allow the User to view, edit and download them (PDF)

The Service is exclusively an assistant: the decision to send an application, the final wording and the responsibility for the content sent to the recruiter remain with the User.

3. Registration and account creation

Access to the Service is reserved to natural persons aged 16 years or older (minimum age applicable in Switzerland for consent to the processing of personal data in an online service).

The User undertakes to:

  • Provide accurate, complete and up-to-date information at registration
  • Keep login credentials confidential
  • Refrain from creating multiple Accounts to circumvent the limits of any free plan
  • Immediately notify the Publisher of any unauthorised use of the Account

The Publisher reserves the right to suspend or delete any Account created in violation of these Terms, without refund of the current period in case of proven fraud.

4. Subscription plans

The Service is offered under the following plans:

  • Free plan: free, no commitment. Limited to 1 Application for the lifetime of the Account. Allows the User to test the Service and assess the quality of generated content.
  • Basic plan: CHF 19 per month incl. taxes. Allows the User to generate up to 20 Applications per month. The counter resets on the subscription anniversary date.
  • Pro plan: CHF 39 per month incl. taxes. Allows the User to generate an unlimited number of Applications, subject to fair use of up to 16 Applications per day, consistent with these Terms.

Prices are shown in Swiss francs (CHF), incl. taxes. The Publisher reserves the right to change its prices at any time; any change only applies to new billing periods and is subject to prior 30-day notice.

5. Payment terms

Payments are processed by Stripe Payments Europe Ltd, an authorised payment service provider. The Publisher does not store any of the User's payment card data; only Stripe and the relevant banking networks have access to it.

The Subscription is monthly, with automatic renewal. Payment is collected on the anniversary date of the first subscription, on the payment method registered by the User.

By subscribing, the User expressly authorises the Publisher, through Stripe, to automatically debit the amount due at each due date, until effective cancellation.

6. Cancellation

The User may cancel the Subscription at any time, without fees or justification, from the "Settings > Subscription" section of the Account, or by email athello@candidat.app.

Cancellation takes effect at the end of the current billing period. The User retains access to paid features until that date.

No prorated refund is owed in the event of mid-month cancellation. Sums already paid remain due to the Publisher.

The User may also request the full deletion of the Account at any time, in accordance with thePrivacy Policy.

6 bis. Refunds and right of withdrawal

The Subscription has no commitment and can be cancelled at any time. No prorated refund is owed for mid-period cancellation: the User keeps access until the end of the paid period, after which no further charge is made.

Billing errors (double charge, technical error on the Publisher's side) are always refunded in full.

As a commercial gesture, two arrangements are offered, each limited to 7 days after payment and no more than one application generatedduring the relevant period: a refund of the first charge for a dissatisfied new subscriber ("satisfied or refunded"), and a refund of a period charged due to a forgotten cancellation.

Right of withdrawal (European Union). candidat.app is a digital service supplied immediately. By subscribing and generating their first application, the User requests immediate performance of the service and acknowledges waiving their 14-day right of withdrawal under European Union consumer law, insofar as the service began to be provided with their consent. This waiver does not affect the commercial gestures described above.

7. Payment failure

In the event of a payment failure (expired card, limit reached, dispute…), the Publisher applies a soft block mechanism:

  • Immediate email notification to the User
  • New automatic payment attempts after 3, 5 and 7 days
  • Suspension of access to paid features after the 3rd failure
  • Retention of data and existing Applications for 30 days
  • Immediate reactivation upon payment regularisation

Failing regularisation within 30 days, the Publisher reserves the right to downgrade the Account to the Free plan and delete Applications exceeding the free-plan limit.

8. Intellectual property

User content: CVs, cover letters and other contents generated fully belong to the User. The User may freely use them without restriction, including after termination of the Subscription.

Publisher content: the source code of the Service, its templates, interface, AI prompts, scoring algorithms and, more broadly, any software component constitute the exclusive property of the Publisher and are protected by Swiss and international intellectual property law.

The User shall in particular refrain from:

  • Copying, reproducing or modifying all or part of the Service
  • Reverse-engineering the Service or its APIs
  • Extracting prompts, templates or business logic to republish them elsewhere
  • Using the Service to train a competing AI model

9. Limitation of liability

The Service relies on generative artificial intelligence. The produced content may include errors, inaccuracies or hallucinations. The User remains solely responsible for reviewing, checking and validating any Application before sending it to a recruiter.

candidat.app is an assistance tool, not a guarantee of results. The Publisher in no way guarantees:

  • Obtaining a job interview
  • Obtaining a job offer
  • Perfect adequacy of generated content with the recruiter's expectations
  • Continuous availability of the Service (reasonable target, no guaranteed percentage, excluding maintenance)

To the fullest extent permitted by Swiss law, the Publisher's total liability, all heads of damage combined, is capped at the amount of the sums actually paid by the User over the 12 months preceding the event giving rise to the claim.

The Publisher shall not be held liable for indirect damages (loss of opportunity, loss of profits, reputational harm…) related to the use of the Service.

10. Personal data

Processing of the User's personal data is governed by thePrivacy Policy, which forms an integral part of these Terms.

The User acknowledges having read this policy before creating the Account and accepts its terms.

11. Swiss legal compliance

The Service is published in Switzerland and subject to Swiss law, notably:

  • The revised Federal Act on Data Protection (FADP / nLPD), in force since 1 September 2023
  • The Swiss Code of Obligations (CO) for the formation, performance and termination of the contract
  • The Federal Act against Unfair Competition (UCA / LCD)
  • The European General Data Protection Regulation (GDPR) for Users residing in the EU

For Users residing in the European Union, the mandatory provisions of national consumer law apply in addition to these Terms whenever they offer more protection.

12. Modification of the Terms

The Publisher reserves the right to modify these Terms at any time. Any substantialchange (pricing, scope of the Service, cancellation conditions, data processing) will be notified to the User by email with a minimum notice of 30 days before its entry into force.

Failing express objection from the User before the effective date, the new Terms will be deemed accepted. In case of refusal, the User may cancel the Subscription free of charge before the changes take effect.

13. Applicable law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules.

Any dispute regarding their interpretation or performance shall fall under the exclusive jurisdiction of the courts of the canton of Vaud, Switzerland (judicial forum of Nyon, La Côte district), subject to mandatory provisions applicable to consumers residing in the European Union.
